Look, I'm going to spend a decent amount of billable hours this week working on a case involving a small business owner who is fighting with the IRS over an interpretation on withholding calculations. That guy followed prior IRS guidance that the IRS is now oh yeah we changed our minds and no, there's no safe harbor because you messed up and trusted us.
This is costing him tens of thousands of dollars in legal fees and the best case scenario is that we can the penalties waived. This is a huge stress to him personally and it's causing him to consider selling out to the PE firm that's sniffing around because he just wants out of dealing with running a business entirely now.
This is a man who tried to do everything properly, who paid what he thought he owed, who has never been late on quarterlies, he's someone who tried to comply.
And the IRS is coming after him because the IRS changed the rules mid-stream.
So when I see things like this? It makes me want to shoot blood from my eyes.
Because that guy? That guy is going to be held up like a hero. That guy, who broke any number of laws, is not going to have to spend years in audit and every time it seems that it's resolved, something else is added on.
And trust me, the business owners who are like our client? They are paying very close attention to this. They are very much no longer interested in polite requests that laws be enforced consistently.
