Trump’s current Border Czar, Tom Holdman, has made it clear — over and over again. If federal agents are blocked from accessing local jails to detain migrants with criminal records, ICE will be forced to make arrests elsewhere — in courtrooms, at job sites, and on the streets. This isn’t new. It was warned about long before Trump even took office.
The reason we’re now seeing ICE show up at work sites and other public locations likely stems from their exclusion from facilities like Rikers Island. This entire mess could be avoided with one simple fix: let ICE agents into the jails.
Under current sanctuary city laws, NYPD officers are legally allowed to notify ICE when a migrant is charged with one of 20 serious crimes. These include violent offenses, gang affiliation, murder, rape, and more. The law is on the books — it exists for a reason. But in practice, internal policies and politics are actively blocking that law from being used.
Over the weekend, we saw exactly what happens when the system fails. Two migrant gang members attempted to rob a Border Patrol agent. That agent was shot. What’s even more disturbing is that these suspects had been arrested multiple times in the past — and what they were arrested for falls under those same 20 crimes covered in the sanctuary city law. If NYPD had notified ICE at the time — as the law allows — those gang members could’ve been deported, and that federal agent would never have been shot. That’s the cost of letting politics override public safety.
What many people don’t realize — and this includes many on the political right — is that most Americans don’t want ICE targeting migrants who are just trying to live normal lives. And that’s a fact. Even among conservatives, there’s wide support for going after criminals, not families or workers just trying to get by.
For myself, as someone widely recognized as a gang expert — specifically a migrant gang expert — my focus has always been on violent criminals, migrant gangs, and individuals tied to designated terrorist organizations. That’s who should be the priority.
This can all end — quietly and efficiently — by simply letting ICE into the jails and enforcing laws already on the books. Until then, we’ll keep seeing federal agents in the streets, and the consequences will continue to fall on law enforcement and innocent people alike.
