Cynical Publius @CynicalPublius - Again and again I am seeing that military JAG officers are acting as steep impediments to the wholly necessary transformational change that Pete Hegseth is bringing about in the Department of War.
If you have some time and want to better understand why this is so, I recommend you do some reading on “critical legal theory.”
Basically it’s the idea that all laws are a function of power imbalances, and that there is no objective basis for “right” and “wrong.”  It’s entirely about power and who has the ability to exercise it.
This contrasts with natural law, which is the basis of the US Constitution and posits that God created mankind with an objective understanding of right and wrong, and all laws are an extension of this.
In the legal profession, law journals are the basis for most emerging thought.  When I went to law school (not that long ago, I’m a second career lawyer), nationally there were hundreds of critical legal theory journals, against exactly 4 natural law journals.
Critical legal theory is the poison that is fed to impressionable law students in law school on a widespread and continuous basis.
I said all this to explain why JAGs are such an impediment to the change that Pete Hegseth is bringing about.  JAGs don’t see things like transgender policies in terms of right/wrong or even what is best for national defense.  They see it in terms of what they consider to be unjust policies based on power imbalances.
If the Department of War is ever going to fix the services' JAG corps and get military lawyers back to supporting national defense instead of their “progressive” political cause du jour, the DoW is going to need to establish a military law school.
Sad to say, that is the only possible solution, costly though it may be.
