Mark Paoletta @MarkPaoletta - This @AdamLiptak @NYTimes piece inaccurately portrays the 1969 memo by DOJ OLC chief Rehnquist as categorically rejecting a constitutional impoundment power. Rehnquist did no such thing. 
Instead, Rehnquist indicated that the President does have impoundment authority in the context of his constitutional functions such as foreign affairs and control of the military. He also indicated that the President has impoundment authority under the Take Care Clause when statutory demands conflict.
One of his successors, Reagan OLC chief (and former Rehnquist clerk) Chuck Cooper (@chascooper23), expressly found that the President has authority to impound funds appropriated for unconstitutional purposes (think race-based DEI program) and reaffirmed that “the President may impound funds where to spend such funds would infringe upon his constitutional responsibilities as Commander-in-Chief or his duties in the area of foreign affairs,” and when resolving conflicting statutory commands. Contra Liptak article, that’s a lot of authority to impound.
Appreciate Mr. Liptak discussing the two @amrenewctr  articles on impoundment I co-authored with Daniel Shapiro (former Justice Thomas clerk), where we discuss the robust history of Presidents impounding funds, with many examples going all the way back to President Washington, and the constitutional basis for this authority.
