James O'Keefe @JamesOKeefeIII - UPDATE: Hearing Held Today in Matthew Tyrmand Family Domestic Violence Court Matter, Judge Questions Basis of Tyrmand Conflict Claim as Hearing Focuses on Attempt to Disqualify Counsel
A hearing was held today in Family Domestic Violence Court involving Matthew Tyrmand's petition stemming from O'Keefe Media Group's February investigative reporting regarding statements Tyrmand allegedly made about James O'Keefe, including claims that he acted as an informant for the Southern District of New York against various conservative groups while working with them, as well as remarks that he "would kill" O'Keefe.
Tyrmand's attorney, Christian Maroni, continued to argue that OMG's reporting constituted "stalking," "cyberstalking," and "harassment."
A significant portion of today's hearing focused on whether attorney Benjamin Barr & Stephen Klein could continue representing O'Keefe in the matter. Maroni argued for approximately 20 minutes that Barr should be disqualified due to alleged conflicts arising from communications Barr had with Tyrmand during Barr's previous tenure at Project Veritas. Barr's representation, however, was of Project Veritas, not Tyrmand personally.
During the exchange, the judge asked whether Barr had ever actually represented Tyrmand. Maroni responded that Tyrmand "believed" Barr had represented him.
The judge then questioned the basis for that assertion, responding: "It's based upon his 'subjective' belief?"
The judge also noted that Barr had already been admitted as counsel for O'Keefe in the related appeal proceedings without objection from Tyrmand's side.
Counsel for O'Keefe, Thomas Kroeger, argued against the disqualification effort, describing it as an attempt at "removing an experienced First Amendment counsel because it has become convenient for the other side."
Kroeger further argued that prior representation of an organization does not automatically create an attorney-client relationship with every individual associated with that organization, stating: "Representing a company does not mean representing a man who sits on its board."
At the conclusion of the hearing, the judge directed both parties to submit proposed orders on their respective positions before issuing a ruling on the disqualification issue.
