January 6 Hearings: Seventh Hearing on Investigation of January 6 Attack on the U.S. Capitol
In her closing statement of the seventh January 6 Committee, Committee Vice Chair Liz Cheney (R-WY) said that former President Trump “tried to call a witness in our investigation. A witness you have not yet seen in these hearings,” and that the matter had been reported to the Justice Department. The witnesses were Jason Van Tatenhove, former spokesperson for the Oath Keepers extremist group, who said the group is a “violent militia” and "the best illustration for what the Oath Keepers are happened January 6 when we saw that stacked military formation going up the stairs of our Capitol, and Stephen Ayres, who pled guilty to breaching the U.S. Capitol. Mr. Ayres said that he was galvanized by the former president’s January 6 speech and that he went to the Capitol because the president told his supporters to do so. The hearing also includes video testimony from former White House Counsel Pat Cipollone and attorney Sidney Powell, among several others.

Al Franken, a comedian, discussed the cable comedy network, Comedy Central. He explained the background behind Comedy Central’s coverage of the Democratic National Convention in New York City in which Mr. Franken wouldl provide humorous commentary during live coverage of the convention. Mr. Franken also talked about his own background in comedy, “Saturday Night Live,” and comic, political impersonations. He performed his impersonation of Paul Tsongas. Earlier that year, “Saturday Night Live” performed two parodies of C-SPAN’s election coverage. Video clips of the Comedy Central set were shown and Mr. Franken humorously responded to the C-SPAN callers.

Deputy Attorney General Rod Rosenstein announced 12 indictments against Russian intelligence officers for conspiring to interfere with the 2016 U.S. election. The Russian officials were charged with hacking Democratic email accounts and with stealing information from approximately 500,000 American voters. The indictment was returned by a federal grand jury in Washington, DC and presented by Special Counsel Robert Mueller’s office.

President Trump delivered remarks in the Rose Garden, announcing he had signed into law the Hong Kong Autonomy Act, as well as an executive order that would end U.S. preferential treatment for Hong Kong. The move came in the wake of new Chinese laws that experts said would restrict individual freedoms and undermine the autonomy of Hong Kong. Despite the event being billed as a Rose Garden news conference, the president spent the majority of his remarks criticizing his 2020 presidential rival, former Vice President Joe Biden. President Trump took questions from reporters after his remarks.

Federal prosecutors must be duly appointed and confirmed by the Senate. He fails both tests.

There’s good news and bad news for special counsel Jack Smith. The good news is that he may not have to confront the thorny issues stemming from the Supreme Court’s presidential immunity decision. The bad news is that the good news may put him out of a job. That result would follow from a finding either that there is no legal authority for the creation of the office of special counsel, that he wasn’t appointed in compliance with the Constitution, or some combination of the two.

The Constitution’s Appointments Clause limits how executive offices can be created and how they may be filled. Before the Revolution, the king could both create and fill offices. The Constitution eliminated that power by giving Congress the authority to create offices or to authorize their creation in specific instances, and requiring the advice and consent of the Senate before the president could fill certain offices. It empowers the president to nominate and appoint “officers of the United States” not specifically provided for in the Constitution only with the advice and consent of the Senate, and only to offices “which shall be established by Law.” The Appointments Clause does allow for the appointment of officers by the president, a court or the head of a department—such as the attorney general—but, again, only when such appointment is permitted “by Law.”

Authority for appointment of the current special counsel doesn’t exist “by Law,” but rather through a set of regulations put in place unilaterally by U.S. Attorney General Janet Reno in 1999. They don’t have the force of a law passed by Congress and signed by the president, and can be changed at any time by any attorney general.

While concurring in the majority opinion on the issue of presidential immunity, Justice Clarence Thomas wrote separately to raise the question of whether any law has created the office of special counsel. He noted that Mr. Smith was appointed by the attorney general, and that Mr. Smith relies not on one but on four statutes as authorizing the office of special counsel. Justice Thomas notes that none of them refers specifically to creating such an office; that two are “generic provisions concerning the functions of the Attorney General”; that a third refers to the duties of an “attorney specially appointed by the Attorney General under law,” which suggests an attorney already appointed under some other law; and a fourth that refers to appointment of “officials . . . to detect and prosecute crimes” and appears in a chapter that creates the FBI, not one that creates prosecutors’ offices.

Here is the "chief judge" of D.C. and every January 6th case (James Emanuel BOASBERG) denying me an answer in open court as to why his judicial oath of office did not conform to statute, under law.
He did not answer, nor read any of my filings on record for the rest of my case.
Instead, he agreed with the J6 prosecutor in giving me 3 months of jailtime NOT for a single non-violent January 6th misdemeanor charge, but because I rightfully refused to acknowledge the false authority of the Court that they NEVER had - due to not signing any proper oaths of office to my case, or any case for that matter.
I was originally reassured by my public defender of no jailtime, so my incarceration had hardly anything to do with J6.  BOASBERG later put out a secretive SEALED bench warrant on me for not complying to oathless officers, to which the Floridian U.S. Marshals were notified of by me, but arrested me on anyway - without even signing the warrant for the duration of my case.
@RonDeSantis' Office was notified, and has still done nothing to protect other January 6th Floridians in his State against an oathless prosecution - in violation of his own oath.

The Washington D.C. Circuit Court of Appeals ruled Tuesday that the 2016 Hillary Clinton campaign and an affiliated super PAC violated federal election law in spending that totaled close to $6 million.

The amount in question is more than 45 times the $130,000 a Manhattan court convicted former President Donald Trump of misreporting in business records during the same 2016 campaign.

It should be noted that the Federal Election Commission and the Justice Department looked at the payments Trump made through his personal attorney at the time, Michael Cohen, to adult film star Stormy Daniels as part of a nondisclosure agreement and declined to prosecute him.

One witness, Greg, told the BBC he was outside the rally and could only hear the former president talking, when he noticed a man on top of a roof.

"We noticed the guy crawling up the roof of the building beside us, 50 feet away from us," Greg said. "He had a rifle, we could clearly see him with a rifle."

Greg said they pointed the man out to police.

"Next thing you know, I’m thinking to myself why is Trump still speaking? Why have they not pulled him off the stage?" he said. "I’m standing there pointing at him... the next thing you know, five shots ring out." Bear in mind the situation is still fluid and the BBC cannot fully verify these early witness reports.

Laura Kavanagh, the commissioner of the New York Fire Department, said on Saturday that she would resign after less than two years in the role, giving no explanation for her sudden departure and capping a rocky tenure marked by infighting at the nation’s largest fire department.
Ms. Kavanagh, 42, was appointed to the role by Mayor Eric Adams in October 2022 after serving as interim commissioner for eight months. She was the first woman to oversee the agency in its nearly 160-year history and the youngest to serve in the role in over a century.
But shortly after taking the helm in fall 2022, Ms. Kavanagh faced pushback from other top officials in the department, who criticized her lack of firefighting experience.
Last year, four of her top chiefs filed a lawsuit, saying that three of them had been unfairly demoted. The demotions, the suit claimed, created a “grave risk,” because they had left the city with no staff chiefs to properly oversee five-alarm fires and with only a handful of officials with four-alarm fire command experience.
In another suit, a group of former chiefs sued Ms. Kavanagh for what they claimed was age discrimination.
In a social media post on Saturday, Joann Ariola, chairwoman of the City Council’s Committee on Fire and Emergency Management, which has jurisdiction over the Fire Department, said that Ms. Kavanagh “should have never been in this position to begin with.”
James Brosi, president of the department’s Uniformed Fire Officers Association, said in a statement that the union looked forward to working with the new commissioner, but he did not mention Ms. Kavanagh. “An agency as dynamic and vital as the F.D.N.Y. requires strong leadership that adapts to the ever-changing risks we face on the fireground,” he said.
Andrew Ansbro, president of the Uniformed Firefighters Association, another union, urged the new commissioner to increase staffing in the department.
Ms. Kavanagh’s resignation comes one year after the abrupt departure of Keechant Sewell, the former commissioner of the New York Police Department and, like Ms. Kavanagh, the first woman in the agency’s history to hold that title.
Mr. Adams has frequently boasted about his appointment of women to top posts in his administration, among them Ms. Sewell and Ms. Kavanagh.
Though Ms. Sewell did not give a reason for her departure, several senior police officials said at the time that she had been undermined by the mayor and his senior aides, including Philip Banks III, the deputy mayor for public safety.
Several other top ranking officials in Mr. Adams’s administration have resigned or have been reshuffled in the last year. Louis A. Molina, the city’s embattled jails commissioner, was moved into a position under Mr. Banks in October.
When Ms. Kavanagh took office, she pledged to make the Fire Department more diverse in both race and gender. Men had led the department since its establishment in 1865, and the ranks have been predominately white and male for decades. A report from September 2022, just before Ms. Kavanagh’s appointment, found that 76 percent of firefighters were white. Only about 1 percent of firefighters were women, the report said.
